Reaffirming all the contents of the International Special Tribunal Resolution for the Need of Establishment of the International Tribunal for the Persecution of Falun Gong, dated 27 January 2004.

Specifically noting that:

The former leader of China and present leader of the military, Jiang Zemin, has misused his authority and hijacked and usurped the powers and resources of the state to wage a personal campaign of suppression resulting in genocide against Falun Gong.

Falun Gong teaches Truthfulness-Compassion-Forbearance and the labels and accusations made by those who persecute Falun Gong against Falun Gong, it practitioners, and its founder are fabricated lies used to:

  1. Justify this eradication campaign;
  2. Deceive people into participating;
  3. Quell opposition and condemnation

The urgent need to address the complete absence of legal accountability for Jiang, who has committed crimes against humanity and thus left a detrimental gap in world governance, justice, and peace.

Recognising that the conduct of Jiang Zemin, the 6.10 Office, and those complicit in these crimes thus meet the definition provided in Article 3, sections (a) -- (e), of the Convention on the Prevention and Punishment of the Crime of Genocide of 9 December 1948, entered into force 12 January 1951:

The following acts shall be punishable:

(a) Genocide;

Recognizing that the four-plus year persecution of Falun Gong were targeted at Falun Gong, its founder, and practitioners with the purpose of eliminating the group and has permeated every level and facet of Chinese society, forcing innocent civilians to take part in these crimes against humanity.

(b) Conspiracy to commit genocide;

Noting that leader Jiang personally ordered the formation of the 6.10 Office on 10 June 1999, approximately five weeks prior to the official crackdown on Falun Gong, with the purpose of "eliminating Falun Gong within three months."

(c) Direct and public incitement to commit genocide;

Noting that the leader Jiang has personally, officially, and publicly directed this genocide against Falun Gong through his 6.10 Office and personally facilitated different venues of national and international media to publicly, personally, and politically incite genocide against Falun Gong in China and around the world.

(d) Attempt to commit genocide;

Recalling Principle 3 of the Nuremberg Principles, which states: "The fact that a person who committed an act which constitutes a crime under international law acted as Head of State or responsible Government official does not relieve him from responsibility under international law."

(e) Complicity in genocide.

Recalling Principle 4 of the Nuremberg Principles, which states: "The fact that a person acted pursuant to order of his Government or of a superior does not relieve him from responsibility under international law, provided a moral choice was in fact possible to him."

Emphasising sections 1, 3, 4, 6, and 7 of General Assembly resolution 3074 (XXVIII) of 3 December 1973 that:

Declares that the United Nations, in pursuance of the principles and purposes set forth in the Charter concerning the promotion of co-operation between peoples and the maintenance of international peace and security, proclaims the following principles of international co-operation in the detection, arrest, extradition and punishment of persons guilty of war crimes and crimes against humanity:

1. War crimes and crimes against humanity, wherever they are committed, shall be subject to investigation and the persons against whom there is evidence that they have committed such crimes shall be subject to tracing, arrest, trial and, if found guilty, to punishment.

...

3. States shall co-operate with each other on a bilateral and multilateral basis with a view to halting and preventing war crimes and crimes against humanity, and shall take the domestic and international measures necessary for that purpose.

4. States shall assist each other in detecting, arresting and bringing to trial persons suspected of having committed such crimes and, if they are found guilty, in punishing them.

...

6. States shall co-operate with each other in the collection of information and evidence which would help to bring to trial the persons indicated in paragraph 5 above and shall exchange such information.

7. In accordance with article 1 of the Declaration on Territorial Asylum of 14 December 1967, States shall not grant asylum to any person with respect to whom there are serious reasons for considering that he has committed a crime against peace, a war crime or a crime against humanity.

Recalling the United Nations Charter, Article 55:

... the United Nations shall promote:

...

c) universal respect for, and observance of, human rights and fundamental freedoms for all without distinction as to race, sex, language, or religion.

And Article 56:
All Members pledge themselves to take joint and separate action in cooperation with the Organization for the achievement of the purposes set forth in Article 55.

In accordance with the United Nations Charter and relevant conventions, resolutions, and treaties urges States and intergovernmental and non-governmental organizations to contribute, equipment, and judicial and investigative services, funds, and equipment to the International Special Tribunal on the Persecution of Falun Gong, including the offer of expert personnel.

Decides also that the work of the International Special Tribunal on the Persecution of Falun Gong shall be carried out without prejudice to the right of the victims to seek, through appropriate means, compensation for damages incurred as a result of violations of international humanitarian law.

Concluding that the establishment of the International Special Tribunal on the Persecution of Falun Gong is in consistent with the pursuit of international peace and security.

Decides to remain actively seized of the matter.
